 Collabrie, Inc., a California corporation ("Collabrie", "we", or "us"), respects the online privacy of its candidates, clients as well as visitors to, and users of, https://collabrie.com/ (the "Site"). The Site is governed by our Terms of Use, which can be found at https://collabrie.com/terms-of-use. This Privacy Policy (the "Policy" or "Privacy Policy") governs, refers, and relates to the information we collect from you from the Site.

 While offering to you the advantages and convenience of web-based technologies, we strive to employ practices ensuring information collected about you is used conscientiously and appropriately, and that steps are taken to ensure your information is kept private.

 This policy does not apply to information you may provide to us, or that we may otherwise obtain, through means outside the Site, such as information given to us over the phone, by mail, or in person. This online Privacy Policy only applies to information collected through this Site.

AGREEMENT TO TERMS OF THIS POLICY AND TERMS OF USE

All activities in which you may engage on this Site are voluntary. You are not required to provide any personal information to us unless you choose to access features on this Site that require the information. If you do not agree with the terms of this Policy or other terms of use on this Site, then you should immediately exit this Site and discontinue using the Site. If you do not agree with the terms of this Privacy Policy and our Terms of Use, please do not provide us with personal information, and leave this Site. The terms of use of this Site are expressly incorporated herein by reference and made a part of this Policy. EFFECTIVE DATE AND CHANGES TO THIS POLICY

This Policy is effective as of November 1, 2020, and will remain in effect except with respect to any of its provisions that are changed in the future, in which case the changes will become effective on the date they are posted on Site or we otherwise notify you of the changes. We reserve the right to change the Policy at any time. Changes, modifications, additions, or deletions will be effective immediately on their posting to this Site. You should check this Policy periodically, as its terms may change from time to time. Your continued use of this Site after we post any such modifications will constitute your acknowledgment of the modified Policy and your agreement to abide and be bound by the modified Policy. We will also revise the "last updated" date found at the beginning of this Policy when we post changes to it.

 

WHAT INFORMATION IS COLLECTED ON THE SITE?

We may ask you for certain information referred to on this Site as "personal information," which includes information that pertains to your identity. Personal information collected about you may include your name, address, date of birth, age, gender, telephone number, email address, and other information we may collect and maintain when you visit our Site and voluntarily contact us through the Site, and/or submissions made through this Site. There may be other instances in which we collect information from you that is more general in nature. Such information may include your Internet Protocol (IP) address, which enables us to identify your computer or device on a Transmission Control Protocol/Internet Protocol (TCP/IP) network, which includes the World Wide Web. Your computer has an IP address, which is required in order for you to communicate with others via the Internet. Such information, including the click stream data and cookies, as mentioned below, may be collected from you whenever you access the site, whether or not you provide us with any other personal information. We also collect personal information through your use of a mobile device, such as a smartphone, tablet, or iPad. This information includes your mobile device identifier, device type, and IP address.

We do not knowingly collect any personal information from children under the age of sixteen (16). The Site is directed to persons who are at least sixteen (16) years of age. If a parent or guardian is made aware of a child under the age of sixteen (16) providing us with personal information through any point of contact, we ask to be contacted at the below address or email address. We will delete the child's information from our files promptly upon receipt of such notification. If Collabrie has actual knowledge that personal information about a person under the age of sixteen (16) has been collected without appropriate parental consent, Collabrie will take the appropriate steps to delete such information.

You are not required to provide all of the personal information identified in this Policy to use the Site or its services, but certain functionalities may not be made available to you as a result. If you do not provide personal information, we may not be able to respond to your requests or provide you with marketing we believe you may find valuable.

 

HOW DOES COLLABRIE COLLECT INFORMATION ON THE SITE?

We collect information about you to develop a thorough understanding of the candidate's work experience, skills and abilities and the client's job requirements. Collabrie engages in both active and passive data collection and processing. We collect through the site personal information you may input, including your name and email address. The Site may also employ click stream tracking, which collects the website you came to the Site from, your browser, where you go within the Site, and any search terms used. Some of this information obtained can be used to identify you while other information is collected on an anonymous basis.

 While visiting our website, we may ask that you provide certain information. Collabrie collects information in many ways, including but not limited to, requesting personal information when you sign up for our newsletter, contact us with a question or concern, or apply for employment with us. When you apply for employment, we ask for your job interests, background, and resume information in order to process your application. We may also use third party providers of candidate information to improve the accuracy and completeness of our candidate database, to increase our understanding of our candidates, and to identify potential candidates.

A "share" tool provided on our website and/or in our emails allows you to send information about our products and offerings to another person. When you use these offerings, we may ask you for the name and information of the other person, and that information will be collected and processed as all other personal information is collected and processed by us. By providing another person's information to us, you represent that you have the authority to do so.

We have several different legal grounds on which we collect and process personal information, including (a) as necessary to perform a transaction, (b) as necessary to comply with legal obligation, (c) your consent, and (d) as necessary for our legitimate interests. Once your information is collected and processed, we retain your information for as long as you remain a candidate or client, for as long as you continue to visit and/or use the Site, or for as long as you continue accepting marketing communications from us, whichever is longest.

 

HOW DOES COLLABRIE USE THE INFORMATION COLLECTED?

We use the information collected to fulfill candidates' and clients' requests for job placement, requests for products, services, or information; personalize your user experience by using your preferences to shape our recommendations about products and services which might be of interest to you; transmit your data to third party service providers; administer promotions; tailor advertising efforts; measure and improve the effectiveness of our website, our marketing endeavors, or our products or services; tailor our online offerings to your preferences; administer surveys; send marketing communications from us or third party service providers which we feel you may be interested in or for other business purposes; and provide customer service or troubleshooting assistance to you.

We do not use automated decision-making without human intervention, including profiling, in a way that produces legal effects concerning you or otherwise significantly affecting you.

 

HOW DOES COLLABRIE PROTECT PERSONAL INFORMATION?

Collabrie takes, and requires its suppliers to take, appropriate steps to keep your personal information confidential. Although we cannot absolutely guarantee there will never be a security problem, we have put in place appropriate security measures to guard against the loss or misuse of the information collected through this Site.

Please keep in mind, however, that whenever you give out personal information online, there is a risk that third parties may intercept and use that information. While Collabrie strives to protect your personal information and privacy, we cannot guarantee the security of any information you disclose online. By using this Site, you expressly acknowledge and agree that we do not guarantee the security of any data provided to or received by us through this Site and that any personal information or other data or information received from you through the Site is provided to us at your own risk, which you expressly assume.

 

WHAT INDIVIDUAL RIGHTS DO I HAVE REGARDING MY INFORMATION?

You have a number of rights regarding the collection and processing of your personal information by us. You may request access to the personal data we have collected and/or processed from you. If the data we have for you is incorrect, you have a right to correct the data. This includes augmenting the data where currently incomplete. You have the right to be forgotten, or the right to require us to delete your data from our database, if certain requirements are met. In these cases, we retain only that information which we are required to retain for legal or business purposes. You have the right to withdraw your consent to our collection and processing your data at any time. If your data has already been collected by us, you have the right to restrict or suspend us from processing your personal data. DOES COLLABRIE USE "COOKIES" AND OTHER TRACKING TOOLS?

We use technologies on the Site including cookies, HTML, and pixel tags to prevent fraud, improve security, assess website performance, deliver content to you that is relevant to what you view on our website and elsewhere on the web, and provide you with enhanced functionality.

They will collect and use non-identifying information about your visits to and interactions with our website through the use of technologies such as cookies to personalize advertisements for goods and services. HOW DOES COLLABRIE RESPOND TO "DO NOT TRACK" DISCLOSURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

 

DOES COLLABRIE USE THIRD PARTY SERVICE PROVIDERS?

Our website may use third party service providers to serve advertisements, send emails, and analyze website traffic on our behalf. These companies may use technologies similar to those outlined above to measure the effectiveness of advertisements and emails. They may also use information about your visits to this Site and other websites so that we can provide advertisements about goods and services of interest to you. For this purpose, we may also provide these third party service providers non-identifiable information about your site navigation and purchases.

We encourage our service providers to adopt and post privacy policies. However, the use of your personal information by our service partners is governed by the privacy policies of those service providers and is not subject to our control.

Collabrie does not sell, trade, or rent your personal information to outside parties. In addition to the kinds of information sharing you might expect, such as displaying what you voluntarily post to public areas on our website, we may share your information:

  • when we believe in good faith that disclosure is necessary to protect our rights or property, protect your safety or the safety of others, investigate fraud, respond to a government, judicial, or other legal request, or to comply with the law;

  • when we believe in good faith that one of our partners may be able to provide a more appropriate product or service (i.e., recruiting or employment opportunities in an industry or field which Collabrie does not service)

  • in connection with a corporate change or dissolution, including for example a merger, acquisition, reorganization, consolidation, bankruptcy, liquidation, sale of assets or wind down of business (your information may be among the assets).

We may provide aggregate statistics about our candidates or clients, sales, traffic patterns, and related site information to reputable third party vendors, but in no case will this aggregate information include your name or contact information.

 

WHAT ARE THE INFORMATION POLICIES OF DATA COLLECTED ON SOCIAL MEDIA PAGES AND FEATURES?

We maintain a presence on several social networking and blogging platforms and we may also incorporate some third party social networking features onto our website. Through these platforms and features, we receive limited personal information about you and your use of social media. This Policy applies to that information equally. In addition, third party social networking platforms have their own privacy policies that explain how the third parties that provide them will use and protect your information. In accordance with those policies (and your privacy settings within your social networking accounts) information about your activities on our social media accounts may be published to your social media accounts (e.g., liking a Collabrie photo on Facebook may be published on your Facebook timeline).

 

DOES THIS POLICY APPLY TO WEBSITES LINKED ON THE SITE?

This Site may provide links to websites not operated by Collabrie. Collabrie assumes no responsibility for third party websites, including but not limited to the privacy practices of those third party websites. We recommend you review the privacy policies of every website that collects personal information from you. This Policy does not apply to any third party websites except as specified herein. To the extent that any linked websites you visit are not owned or controlled by us, we are not responsible for the websites' content, any use of the website, or the privacy practices of those websites.

 

DOES COLLABRIE ENGAGE IN CROSS-BORDER DATA TRANSFERS?

Our computer systems are currently based in the United States, so your personal information will be processed by us in the United States where data protection and privacy regulations may not offer the same level of protection as in other parts of the world, such as the European Union. Where permitted by applicable law, by submitting your personal information to this Site, you consent to the transfer of your personal information within the United States. We take steps to securely maintain personal information transferred into and within the United States.

 

HOW CAN CUSTOMERS OR VISITORS BECOME INFORMED ABOUT CHANGES TO THE POLICY?

DO CALIFORNIA RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

Under California Law, California residents have the right to request in writing from businesses with whom they have an established business relationship: (a) a list of the categories of personal information, such as name, email, and mailing address, and the type of services provided to the customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes and (b) the names and addresses of all such third parties. To request the above information, please submit your request to info@collabrie.com. We will respond to these requests within thirty (30) days. Requests that come by other means may result in a delayed response.

 If you are under 18 years of age, reside in California, and have a registered account with the Site, you have the right to request removal of unwanted data that you publicly post on the Site. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Site, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g. backups, etc.).

Verification Process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with the information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

 We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

Other Privacy Rights

  • you may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the data

  • you can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.
